Practice/Industry Group Overview
Foreclosure, Eviction & Bankruptcy
WNCW offers the convenience of a one-stop shop for lender services. Working with creditors and lenders we offer comprehensive representation through all stages of mortgage foreclosure from the notice of foreclosure through sale, eviction and representation of lenders' interest in bankruptcies. WNCW understands the complexities and deadlines of the foreclosure process and works to handle matters expeditiously.
For foreclosures, this starts with case intake and notice letter and ad preparation, and includes the necessary title review and recommendations, and crying the foreclosure sales. When foreclosures end up in bankruptcy or if eviction is necessary after a sale, WNCW stays involved with the bankruptcy cases and plans to take action as needed in litigated bankruptcy cases. We also handle eviction notices, filings, paperwork and litigation. WNCW brings the variety of expertise and legal disciplines needed to get the job done.
A core group of experienced attorneys make up our residential and commercial foreclosure teams. They bring specialized expertise, an understanding of residential and commercial real estate law and an understanding of the needs of financial institutions together with a commitment to exemplary customer service. This combination allows us to successfully meet the needs of our clients effectively and efficiently.
Real Estate Owned (REO) Property
WNCW’s REO Department offers one point of contact with the convenience of 17 closing offices. A team of attorneys and paralegals with over 10 years of experience in this field understand the details and timelines associated with closing REO properties.
Working with lenders in a responsive manner, WNCW’s REO Department provides complete closing services from cradle to grave including title clearance, seller representation, and associated services throughout the state of Georgia and Tennessee. Our team runs preliminary title searches using WNCW’s title company, Greater Atlanta Title, and clears title to ensure that there are no delays upon receipt of the contract. Our REO Department prepares all necessary documents for the closing process. As a result, when we close our REO sales, we are able to ensure the wire and final HUD-1 are sent to the seller immediately after closing. Our web-based technology ensures a transparent and seamless closing process.
We also have the unique capability to host a closing at any one of our Georgia locations. While our seller maintains one point of contact, buyers and agents have the opportunity to select a closing office to their convenience. As an added benefit to our REO clients, we enjoy long-standing relationships with our primary title underwriters including Fidelity National Title Insurance Company, First American Title Insurance Corporation, and Chicago Title Insurance Company, who work with our attorneys to overcome title clearance issues. WNCW attorneys know how important accuracy, efficiency and timeliness are to REO closings and we use our resources to benefit our clients.
