What is Mediation?
Mediation is an attempt to resolve a dispute among parties with the help of a neutral third party. The mediator is a fascilitator who keeps the dialogue open and may offer suggestions for possible ways to come to a mutually agreeable solution. The ultimate decision as to the final resolution of the dispute remains with the parties.
Because mediation is confidential and private, options and solutions can be identified in ways not readily apparent in adversarial settings.
What is Arbitration?
Disputes in arbitration are submitted to one or more impartial individuals for a final and binding decision. The parties control the range of issues to be resolved, the relief to be awarded as well as many procedural aspects of the process. The arbitration hearing is private and less formal than a trial. It also utilizes experts in the areas in dispute as opposed to a judge and jury who may not be familiar with the issues and the law.
The arbitrator's decision or award is made in writing and is enforceable in court under state and federal statutes.
