ITC Institutes Investigation (337-TA-856) Regarding Certain Wireless Communication Devices

On September 18, 2012, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Wireless Communication Devices, Portable Music and Data Processing Devices, Computers, and Components Thereof (Inv. No. 337-TA-856).

The investigation is based on an August 17, 2012 complaint and a September 6, 2012 letter supplementing the complaint filed by Motorola Mobility LLC of Libertyville, Illinois, Motorola Mobility Ireland of Bermuda, and Motorola Mobility International Limited of Bermuda alleging violation of Section 337 in the importation into the U.S. and sale of certain wireless communication devices, portable music and data processing devices, computers, and components thereof that infringe one or more claims of U.S. Patent Nos. 5,883,580, 5,922,047, 6,425,002, 6,493,673, 6,983,370, 7,007,064, and 7,383,983. According to the Notice of Investigation, the ITC has identified Apple Inc. of Cupertino, California as the sole respondent in this investigation.

Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that Robert K. Rogers, Jr. will be the presiding Administrative Law Judge in this investigation.
