New FTC Guidelines Streamline Merger Review Process

On Tuesday, March 4, 2003, the American Bar Association sponsored a teleseminar entitled "The FTC's New Guidelines for Reviewing Mergers: What Antitrust and Transactional Lawyers Need to Know." The teleseminar provided an understanding of: (1) the FTC's motivation for improving the merger review process; (2) the parameters of the new guidelines; (3) how the FTC believes the changes should speed and lower the cost of merger review; and (4) inside and outside counsel's views of the efficacy of the process. This article generally summarizes certain of the views expressed by teleseminar participants.
