Alberta Court of Appeal Upholds the Cap

In a key decision released today, the Alberta Court of Appeal unanimously overturned the trial decision of Associate Chief Justice Wittmann, in which the trial judge had concluded that the cap on general damages for "minor injuries" suffered in a motor vehicle accident was unconstitutional.
