Amendments to the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act in Force

In 2005 and 2007 the Parliament of Canada passed statutes to amend the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3 (the "BIA") and the Companies Creditors' Arrangement Act, R.S.C. 1985, c. C-36 (the "CCAA"). Some amendments to the BIA and CCAA were proclaimed in force on July 7, 2008. The remainder will come into force on September 18, 2009. The most significant amendments to the BIA and CCAA are set out below.
