The effects of energy industry challenges are felt globally. The regulatory climate changes constantly, sometimes in positive ways (incentives for power plant construction) and other times in problematic directions (increased FERC penalties and rate-making scrutiny). Business practices are also in flux, from construction techniques to takeover strategies. And the threat of mass action litigation is constant. These issues pose significant concerns for in-house counsel.
