The Office of Federal Contract Compliance Programs (OFCCP) recently established heightened procedures for pre-award clearance evaluations and compliance evaluations of federal government contractors with contracts funded under the American Recovery and Reinvestment Act of 2009 (ARRA). Most notably, all ARRA funded contractors are now subject to pre-award clearance evaluations, all ARRA funded supply and service contractors are now subject to full compliance evaluations, and all ARRA funded construction contractors will now receive greater levels of OFCCP scrutiny. Additionally, certain scheduling exceptions applicable to standard compliance evaluations are now inapplicable to ARRA compliance evaluations.
