On February 5, 2009, the U.S. District Court for the Southern District of New York overruled an Opinion Letter issued by the General Counsel of the U.S. Consumer Product Safety Commission ("CPSC") regarding the sale of products violating the phthalate prohibitions established under the Consumer Product Safety Improvement Act of 2008 ("CPSIA").
