There are infinite reasons why receiving a North Carolina Traffic Ticket is an experience you never want to go through. The entire experience is an embarrassing one. From being pulled over, waiting on the side of the road during the Officer’s investigation, to sitting in court waiting for your case to be called, you are stuck wondering how this will effect you. What will this mean for your driver’s license? Will this affect your Insurance Premium Costs? Anyone who has gone through this understands what I mean. As a Raleigh Traffic Attorney and a Durham Traffic Attorney I have seen many people come through the Traffic Court System. Often time’s people coming through Traffic Court do not know what to expect or what is required of them. There are instances where court cases can be handled in an efficient manner, such as when charged with Improper Equipment or when pleading to Improper Equipment. The State handles an Improper Equipment conviction in what is known as a “non-moving violation”. While these charges used to only carry a $10 fine above the charge for a normal speeding ticket, the North Carolina General Assembly, as of August 1, 2011, has added a $50 surcharge as well. As already raised Court Costs continue to rise, this $50 surcharge just creates another added cost for North Carolina drivers on what should be a simple, non-moving violation. It is important to be aware of the counties in North Carolina that will permit a Defendant to plead to Improper Equipment. Wake County, for example, which houses North Carolina’s capital, Raleigh, will not allow a person to plead to Improper Equipment.
