On January 21, 2009, the United States Supreme Court decided Fitzgerald v. Barnstable School Committee, holding that parents and emancipated students can bring a student-on-student gender discrimination claim in Federal Court against public school officials under Title IX of the Education Amendment of 1972 and 42 U.S.C. § 1983.
