Law of 26 March 2012 Amending the Luxembourg Law of 13 February 2007 on Specialised Investment Funds

byArendt Medernach - Luxembourg Office

June 15, 2012

The law of 26 March 2012 amending the Luxembourg law of 13 February 2007 on specialised investment funds (the “New SIF Law”) officially entered into force on 1 April 2012 after having been adopted by the Luxembourg Parliament on 6 March 2012 . The New SIF Law foresees several important changes to the regime governing specialised investment funds or “SIFs”, impacting both existing and future structures. Such changes result from, among others, the implementation of certain measures under the Alternative Investment Fund Managers Directive (the “AIFMD”), the past experience of the Luxembourg regulator (the Commission de Surveillance du Secteur Financier or “CSSF”) and the alignment with certain provisions of the Luxembourg law of 17 December 2010 on undertakings for collective investment (the “UCI Law”) deemed equally beneficial for SIFs.
