On January 3, 2012, the American Taxpayer Relief Act of 2012 (ATRA) was signed into law, averting some of the worst effects of the “fiscal cliff.” The provisions of the law went into effect immediately, and included some provisions not tied to tax and spending issues. Title VI, in particular, included some important provisions for the Medicare and Medicaid programs. Tucked among the health program-related provisions of ATRA was § 638, titled “Removing obstacles to collection of overpayment.”
