"Improved Enforcement" of Privacy Laws

The Secretary of Health and Human Services ("HHS") issued new enforcement regulations on October 30, 2009 in order to conform HIPAA regulations to the Health Information Technology for Economic and Clinical Health Act (the "HITECH Act"). The HITECH Act provided for "improved enforcement" of privacy laws and increased the civil penalties for noncompliance with the HIPAA privacy and security rules. The interim final rule is effective November 30, 2009.
