New H-2B Visas Available for Current Federal Fiscal Year

Starting May 25, 2005, the U.S. Citizenship and Immigration Services ("USCIS") of the Department of Homeland Security will once again accept petitions for H 2B visas for the current federal fiscal year which ends on September 30, 2005. The annual cap of 66,000 H-2B visas for the fiscal year had previously been reached on January 3, 2005, but the Save Our Small and Seasonal Business Act of 2005, signed by the President on May 11, 2005, has now made additional H-2B visas available. H-2B visas allow for the employment of foreign nationals in non-agricultural work that is seasonal, satisfying a peak-load or intermittent need of an employer, or non-recurring.
