Pensions: Proposed Changes to TUPE

For employers selling or contracting-out parts of their business in a manner covered by the Transfer of Undertakings (Protection of Employment) Regulations 1981 ("TUPE"), one legislative shake-up that will impact how a deal is structured from now on (and what it will cost) arises out of the Pensions Act 2004. This finally provides limited protection for the occupational pension rights of transferring staff.
