On November 2, 2004, Florida voters approved a constitutional amendment which created Florida's minimum wage. The minimum wage applies to all employees in the state who are covered by the federal minimum wage. Florida's current minimum wage is $7.21 per hour, which is higher than the current minimum wage set by federal law. However, on July 24, 2009, the federal minimum wage will increase to $7.25. Federal law dictates that Florida employers pay their employees the federal minimum wage if it is higher than the Florida minimum wage. Accordingly, beginning July 24, 2009, Florida employers must increase their minimum wage from $7.21 to $7.25.
