This Article provides the practitioner with a working knowledge of when an oil and gas interest is considered a security under federal law, Texas law, or both. Then it examines the private rights of actions available to defrauded investors under federal and Texas law. Particular attention is given to the significant differences between the Texas Securities Act and the federal securities laws. The Article concludes by identifying which law typically provides the most relief to defrauded investors.
