  • The court found that Justice Farley lacked jurisdiction under the Companies Creditors Arrangements Act to remove Stelco's directors. Moreover, his decision to remove the directors was based on mere speculation as to how they might act, which was not a sufficient basis for such an extraordinary remedy.
