• Ninth Circuit Court of Appeals Refuses To Overturn Denial of Class Certification in Female Wal-Mart Workers' Appeal

  • On November 18, 2013, the Ninth Circuit denied a petition to appeal the order denying class certification in Dukes v. Wal-Mart Stores - a case in which female Wal-Mart workers have spent over twelve years pursuing claims of alleged discrimination in pay and promotions. Plaintiffs filed their lawsuit in 2001 and were initially successful at the district court level in certifying a nationwide class of 1.5 million former and current female employees. Wal-Mart appealed this class certification to the Ninth Circuit, which affirmed, and then to the Supreme Court, which reversed, holding that plaintiffs had failed to identify a "common question" tying together the claims of the 1.5 million class members.
