Biography

Jonathan represents clients involved in the development of large scale energy, industrial, commercial, and institutional facilities, from project inception and design and construction to closeout. He has represented clients in contested proceedings (both arbitration and litigation) involving enforcement of mechanic's liens, surety bonds, design and construction defects, and claims relating to scope changes, changes in regulations or law, and schedule delays and acceleration. A significant part of his practice involves providing legal and strategic advice to clients in the energy sector, including the owner of the first American nuclear power plant in 30 years and one of the largest industrial boiler manufacturers in the world.

He also counsels clients in government contracting matters, including bid protests and debarments, suspensions, and other legal actions brought by state and federal governments. As well, he regularly prepares and negotiates construction agreements for projects around the world tailored to fit the client's financial, organizational, and time constraints. Recent work includes preparation of EPC contracts, architect/engineer contracts, turnkey and incentive fee/target price arrangements, design/build contracts, guaranteed maximum price contracts, and multiple prime contracts, often in conjunction with venture/teaming agreements, letters of credit, and other forms of security.

Jonathan received his law degree from the University of Chicago Law School, where he was a Ruth Wyatt Rosenson Scholar, and his bachelor's degree, summa cum laude, from the University of Florida. Fluent in Korean, he is admitted to practice law in the states of Georgia, Florida, and New York.

Representative matters include:

· Counsel to one of the world's largest industrial boiler manufacturers in arbitration over the supply and construction of a coal-fired utility boiler and related equipment.

· Counsel to a large utility in construction and contract claim in connection with a multibillion-dollar nuclear plant project.

· Represented a HRSG power plant contractor in a dispute with the owner over cost overruns stemming from defective specifications, delays, disruption, lost productivity and differing site conditions.

· Drafted and negotiated a joint venture fast-track construction contract for the development of a 250 acre entertainment complex.

· Led briefing efforts in Equal Rights Ctr. v. Niles Bolton Assocs., 602 F.3d 597 (4th Cir. 2010) (owner may not pursue indemnity claims against the architect to recover compliance costs under the ADA and the FHA), cert. denied, 131 S.Ct. 504.
