  • On August 25, 2016, the Bankruptcy Appellate Panel for the Ninth Circuit issued a decision holding that a Bankruptcy Court lacks jurisdiction to hear a case involving the scope of coverage under a pre-petition insurance contract, despite the insurer’s argument that coverage should be denied based on the Debtor’s post-bankruptcy conduct.
