David's practice is focused on tax litigation and tax controversy cases, involving both the IRS and the Department of Revenue. Most recently, he has emphasized defending conservation easements, including the landmark Kiva Dunes case in United States Tax Court. During his 41 years with Sirote, David’s practice has included tax planning, state and local tax issues, family succession and business planning, shareholder oppression, and director and fiduciary liability issues. He served as Sirote’s managing partner from 1992 to 1999.

What is the best part of your job?

Teaching and training younger lawyers and other team members the skills needed to perform at the highest levels of which they are capable.

Who has inspired you in your career?

I have had several mentors at Sirote, many of whom would not have thought of themselves in that light. I am blessed to have had a broad practice that brought me into the orbit of many good lawyers. From each of them, I studied the best of what they did and tried to incorporate it into my practice. Technical legal skills, of course. But of most importance are the “soft” skills required to work effectively with clients and their other advisors, with opposing lawyers, judges, and other stakeholders.It’s important to communicate with each person at their level of understanding and abilities. The content, tone, and manner of each communication is critical to a person’s grasp of the situation.

What are you most proud of in your practice?

Having developed over 40 years a highly skilled practice and, over the last 20 years, having built a highly skilled practice team to support and extend that practice. At this point, my team can independently provide our clients with every bit of expertise and skill that a client might come to me for.

What do you think are the three most important things you do to serve your clients?

1. Provide them my technical expertise, naturally. But I try to help them understand our recommendations and why we make them.

2. I try hard not to be a “two-handed” lawyer-on the one hand this, and on the other that.

3. Clients are entitled to advice that is as practical and useful as I can make it. They are also entitled to understand the advice at a practical level and depth.

What do you like to do in your spare time?

I now read extensively, which I was unable to do earlier because of career and family demands. I play golf when I can, and I love to travel. My most cherished time is that spent with my grandchildren. Having lost both of my grandfathers early, I take every opportunity to build memories with each grandchild.
