Kevin M. Sibbernsen is a Principal in the Portsmouth, New Hampshire, office of Jackson Lewis P.C. Mr. Sibbernsen has defended employers in litigation in state and federal courts, including wage and hour litigation and litigation under the Employee Retirement Income Security Act (ERISA), Sarbanes-Oxley Act, and state and federal anti-discrimination statutes, and has represented employers in administrative proceedings before the Massachusetts Commission Against Discrimination.

While attending law school, Mr. Sibbernsen was the Executive Notes Editor for the Georgia Journal of International and Comparative Law.

NLRB General Counsel Urges Reversal of Purple Communications Email Rule

The National Labor Relations Board’s office of the General Counsel is urging the Board to overrule its decision in Purple Communications, Inc., 361 NLRB 1050 (2014), which allowed employees to use employer email systems for NLRA Section 7 purposes (e.g., union organizing and protected concerted activity) during nonworking time.
