Biography

Ralph Rivkind represents closely-held businesses, non-profit organizations, and families and individuals in the areas of taxation, business law, banking, commercial transactions, real estate, and estate planning and estate administration.

Ralph serves on several Boards of Directors, both public and charitable. For clients he has served as a trusted advisor to multiple generations of owners in family-held businesses. He has worked with clients as they have grown - in one example, from a small local business with three stores to a chain with more than one hundred locations throughout New England; in another case, he worked with an entrepreneur to start-up a company which now has more than $1 billion in sales.

Clients such as these seek Ralph's assistance in acting as their general counsel in handling all legal matters as their businesses grow. Ralph counsels on employment issues, real estate transactions, tax matters and, most importantly, helping clients avoid inter-family strife upon death of the founders.

Ralph recently participated in a lawsuit against a major international bank for deceptive actions against a customer, in which the court awarded restitution, double damages, and attorneys' fees.

Ralph Rivkind is the recipient of numerous honors, and has been recognized by The Boston Globe as one of Boston's Top-Rated Lawyers.

Significant Cases: Ralph J. Rivkind has been involved in an important case between customers of a major multistate bank and how the customer was treated when the bank desired to terminate the relationship. The bank created the illusion of retroactive defaults, despite the borrower's never being late on any payments of multiple loans for several decades. When it was clear that the relationship was irretrievable, the bank charged thousands of dollars in interest that were not set forth in the agreements, some retroactively, double billed legal fees and gave an incorrect payoff letter for a closing with a new bank that occurred 11 days after the letter was delivered. Then they charged another $750 to fix their own mistake.; The Suffolk Superior court awarded the customer back all of the penalty interest and added interest (at the statutory rate of 12% per annum) for over 7 years that the case dragged on, then doubled the amount of the original claim under Ch. 93A, and added plaintiff's legal fees in the amount of over $175, 000. The double billing of fees was finally acknowledged 4 months after the suit was filed and returned.; The net effect is the bank's attempt to try and increase profits from a customer that it wanted to leave anyway by a net $37, 000, which turned to be a judgment in the approximate amount of $300, 000.; A few months later a second case arose with the same bank and Attorney Rivkind was asked by MLW for comments based on the participation in the case described above.; Bank liable under 93A for actions against borrower; Forged checks result in sizable 93A verdict
