  • Quite often, a franchise tenant is required to execute a personal guaranty, a requirement imposed by the landlord in order to insure that the tenant will honor its lease obligations. This is a logical requirement, but is it negotiable? All too often it is, yet the impatient tenant routinely executes the guaranty without a second thought, without any modifications change. It's important to consider a few salient points in order to protect the unsuspecting tenant-guarantor.
