  • Dilution was always a factor in trademark clearance even before the Federal Trademark Dilution Act (15 U.S.C. 1125(c)). However, the enactment of the FTDA and more recently the addition of dilution as a basis for opposition or cancellation proceedings before the Trademark Trial and Appeal Board, have significantly increased the importance of this "wild card" as well as the necessity of effectively integrating dilution issues into the searching and clearance process.
