Biography

Since completing law school in 2008, Ashley has developed a practice focused on insurance defence. She acts as counsel for matters involving motor vehicle accidents, fatalities, fires, floods, product liability, director and officers liability, and coverage.

Ashley has experience defending individuals facing professional liability actions, obtaining expert evidence on the duty and standard of care applicable, calculating damages and resolving liability claims against professionals. She has also acted as counsel for contractors in commercial litigation matters, including negligent construction of condominiums.

Ashley has experience in all aspects of litigation and has attended numerous settlement conferences, private mediations and Judicial Dispute Resolutions. Ashley relies on her experience to assist in resolving claims with interest based negotiation and is focused on reaching cost-effective settlement of her insurance clients' claims. Ashley has appeared at all levels of the Alberta Courts as well as before the Alberta Securities Commission.

Insurance Litigation

Ashley has successfully defended insurance clients in a variety of claims dealing with motor vehicle accidents, floods, fires, slip and falls, dog bites, and product liability and has negotiated both liability and quantum at settlement meetings, mediation and Judicial Dispute Resolution.

Representative Experience

•Ashley successfully negotiated the resolution of a fatality claim on a nuisance basis, with significant contributory negligence being apportioned to the deceased after a car-surfing accident.
•Ashley has acted as counsel for the Defendant in an action where the Plaintiff sustained a toe amputation while visiting the Defendant's residence. The Plaintiff claimed pursuant to Occupiers' Liability Legislation and significant contributory negligence was apportioned to the Plaintiff in final settlement.
•At a Judicial Dispute Resolution, Ashley acted as counsel and successfully resolved a motor vehicle claim involving a crush injury to the Plaintiff's hand, when it was caught and broken in a tailgate of a truck.
•Ashley was involved in the successful mediation of five separate claims in the British Columbia courts, arising from a head-on highway speed traffic accident and resulting in significant orthopaedic injuries and chronic pain complaints.
•Ashley was retained as counsel for the Defendants in a dog bite claim after the Plaintiff sustained a fractured arm while visiting a farm property. This claim was successfully negotiated at a Judicial Dispute Resolution with the Plaintiff accepting significant contributory negligence.

Construction Litigation

Ashley has acted as counsel in negligence claims against contractors in construction litigation cases, dealing with structural and building envelope deficiencies in condominium complexes.

Representative Experience

•Ashley was involved in litigation arising from condominium construction and successfully negotiated a discontinuance of claim on several actions commenced against a subcontractor.
