Colin has valuable Courtroom experience, including running small claims trials and contested Queen’s Bench and Provincial Court Chambers. Colin has participated in alternative dispute resolution, including pre-trial conferences, mediation, and Judicial Dispute Resolution conferences. Colin also has a diverse background in administrative law; having acted in resolution conferences and hearings at the Alberta Labour Relations Board and various other administrative bodies.
•Acted as lead counsel in constructive trust matter associated with a family business valued at nearly $10 million.
•Acted in multiple builders’ lien matters and construction disputes; including being lead counsel in a matter involving nearly $1 million in liens.
•Experienced in residential and commercial landlord & tenant matters, and has appeared in Residential Tenancy Dispute Resolution Services hearings and in Queen’s Bench and Provincial Court Chambers regarding these matters.
•Experience with the Alberta Surface Rights Board, including the preparation of applications for compensation review and recovery of rentals.
•Acted as lead counsel in shareholder meetings, shareholder disputes, actions for oppression, and actions involving improper behaviour on the part of the director(s).
•Successfully defended clients from public utilities seeking compensation for downed power lines.
•Acted for a municipality in seeking an order declaring a breach of a local bylaw and compliance provisions.
•Acts for clients in matters involving insurance fraud.
•Acted as lead counsel in questionings for personal injury matters.
Labour & Employment
•Acted as lead counsel for several employees and employers, among them a municipality, in resolving wrongful dismissal claims and severance disputes, with and without union involvement.
•Acted for a local operation fighting the unionization of its workforce and appeared in resolution conferences and hearings in front of the Alberta Labour Relations Board.
•Acted as counsel in dealing with the Workers’ Compensation Board in order to reinstate benefits that ceased.
•Advises clients on and reviewed severance offers, commercial leases and franchise agreements.
•Experience in dealing with breach of non-competition and non-solicitation contract provisions.
