Ms. Hofbauer concentrates her practice on estate planning, the administration of trusts and estates, and issues affecting families and the elderly.
Ms. Hofbauer advises clients on estate planning techniques aimed at ensuring that assets pass to the intended beneficiaries, and drafting wills, trusts, powers of attorney and living wills.
Ms. Hofbauer also assists clients with respect to trust and estate administration, ensuring that the probate process is conducted in accordance with applicable law and that executors and trustees fulfill their fiduciary duties.
Ms. Hofbauer also handles probate litigation cases, such as conservatorships, guardianships, will contests, claims or defense of claims of breaches of fiduciary duties by trustees and other fiduciaries (e.g., self-dealing, conflicts of interest, breach of trust), accountings, petitions for court instructions, issues of trust modification and reformation, allegations or protection from allegations of undue influence or fraudulent conveyances, and interpretation, advocacy, or defense of testamentary capacity and decedent’s intent.
Ms. Hofbauer also has had extensive experience in commercial litigation, bankruptcy and municipal law which complements her current practice. She has represented clients in state and federal bankruptcy court litigation and was responsible for developing litigation, discovery, settlement and trial strategies. Ms. Hofbauer is skilled at drafting pleadings, motions, agreements and discovery documents and researching complex legal issues. Ms. Hofbauer has been actively involved in her community for over twenty years, volunteering her time and serving on various community organization boards and committees.
