  • In 1991, the U.S. Sentencing Commission ("USSC") established sentencing guidelines for organizational offenders such as corporations that have been found guilty of violating Federal securities or anti-trust laws. In the wake of a now familiar litany of high profile corporate scandals, the USSC has promulgated a set of revisions to the guidelines, which, barring Congressional action, will go into effect on November 1, 2004. This is the first time the organizational guidelines will have been amended since inception.
