  • A city's determination of how assessments should be levied under a special assessment district must be affirmed if supported by substantial evidence. Assuring that the decision is supported by substantial evidence also complies with Proposition 218, which places the burden of proving the validity of the assessment on the City. Dahms v. Downtown Pomona Property and Business Improvement District, B183545 (2006).
