Biography

Amber J. Munck is a trial attorney with experience in virtually all aspects of complex class action and commercial litigation. She focuses her practice on a wide range of employment and business matters, including the defense of wage and hour class and collective actions and discrimination claims, as well as a broad range of business torts, real estate disputes, contracts and statutory claims.

Amber’s employment practice involves counseling and representing employers with regard to their compliance with federal and state wage and hour laws, including the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), Title VII of the Civil Rights Act of 1965, the American with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Colorado Wage Claim Act, Colorado Minimum Wage Act and Wage Order Number 24, and Colorado’s Family Medical Leave Act, among others. She has defended employers in litigation involving claims of discrimination, harassment, retaliation, and wrongful termination, among others. Amber appears regularly in federal and state courts in Colorado and across the country, and defends employers against charges filed with the Equal Employment Opportunity Commission, the Colorado Civil Rights Division, and the Colorado Department of Labor. She recently acted as coordinating counsel in the defense of more than 70 class and collective actions nationwide for a Fortune 5 company. Amber represents other companies in the retail, restaurant service, automotive, logistics and consumer electronics industries, among others.

Amber advises and trains management and in-house counsel on a broad spectrum of employment issues, with an eye toward avoiding litigation altogether, including in the areas of hiring, firing, harassment, diversity, misconduct, leave and attendance, employee accommodations, employment and severance agreements, executive contracts, independent contractors, internal investigations, background checks, and employee handbooks and policies.
