Biography

Mr. Gogarty has extensive litigation experience, with a background as both a civil and criminal attorney. As a civil litigator, Mr. Gogarty has successfully defended high-exposure cases through trial, and obtained complete defense verdicts. Mr. Gogarty’s civil practice focuses primarily on commercial litigation and high value tort claims involving death or claims of serious and permanent injury. This includes defending premises liability claims, dram shop claims, personal and commercial vehicle accident cases, aviation claims, and industrial vehicle and machinery claims. He has also defended product liability claims, contractual disputes, subrogation claims, and construction defect cases. Mr. Gogarty has significant experience participating in hearings, drafting and responding to written motions, negotiating settlements, and mediating cases.

Prior to joining Hall & Evans, Mr. Gogarty was a felony prosecutor in Colorado Springs, which carried the highest felony case load in Colorado at the time. As a prosecutor, he was responsible for managing cases from filing through verdict and overseeing the investigation and prosecution of drug offenses, felony theft, and violent crimes - including homicides, assaults, robberies, and domestic violence. He oversaw the vehicular homicide unit, which investigated hit-and-run accidents and drunk driving incidents involving fatality or serious injury, and assisted the special victim unit in prosecuting sexual assaults. Mr. Gogarty provided training at conferences throughout the state to other prosecutors and law enforcement on trial skills and technique. The litigation and trial skills he developed in his years as a prosecutor have carried over to his current civil practice.

Mr. Gogarty is an active member in the Colorado Bar Association and the Denver Bar Association.
