Biography

Kevin Feth has more than 25 years of experience managing complex labour and employment, education law and civil litigation for clients in Alberta and throughout Canada.

Kevin is the past Chair of the firm s Labour and Employment Practice Group in Edmonton. He has represented clients in labour arbitrations (under both provincial legislation and the Canada Labour Code) before the Alberta Labour Relations Board and the Alberta Human Rights and Citizenship Commission. Kevin also provides strategic advice to clients about collective bargaining, human rights, the duty to accommodate, interest arbitration, corporate reorganizations, management of personnel, privacy and rights of public access to information. His clients include public institutions, professional associations, provincially and federally regulated corporations, Metis Settlements and First Nations.

Kevin was a sessional instructor in Labour Law at the University of Alberta Law School from 2004-09 and co-authored Remedies in Labour, Employment and Human Rights Law (Carswell 1999). He is also past Chair of the Employment Insurance Board of Referees for the Alberta Regional Division.

Kevin is the Chair of the firm s Post-Secondary Education Practice Group and a member of the Canadian Association of University Solicitors. As senior legal advisor to Canada’s second largest university and counsel to several other post-secondary institutions, he provides legal advice about institutional policy, legislative compliance, labour relations, human rights, research integrity policies, government policy and administrative practice and procedure.

In addition to his labour/employment and education law practises, Kevin also manages a broad range of civil litigation matters, including product liability defence, commercial lawsuits and arbitrations, professional liability defence and policing law. He is the past Chair of the Canadian Bar Association s National Civil Litigation Section and the Civil Practice Advisory Committee of the Law Society of Alberta. Kevin is also a frequent instructor in Civil Litigation at the Alberta Bar Admission/CPLED course.

Kevin has appeared before the Supreme Court of Canada, all court levels in Alberta, the Federal Court of Canada, numerous administrative tribunals (including the Law Enforcement Review Board, the Farm Implement Board and the Alberta Hospital Privileges Appeal Board) and local and international commercial arbitral panels.

Kevin keeps clients focused on the tasks and challenges involved in the case at hand, as well as the big-picture objectives they are seeking to achieve by litigating a dispute. This approach enables Kevin’s clients to have a stronger understanding of the multi-layered issues that are involved in complex litigation and how they impact adversaries and other parties, the public’s perception of the case and clients’ ability to move forward successfully when the dispute is ultimately resolved.

Outside the Office

Kevin enjoys traveling and outdoor activities with his family, including hiking and mountain climbing.

•Successfully defended managers and co-workers at Canada Post both at trial and on appeal against a lawsuit by an employee alleging harassment, intimidation and bullying (Sesek v. Awad)

•Secured dismissal of a professor’s Statement of Claim alleging constructive termination from the University of Alberta in violation of his employment agreement; the court concluded that it lacked jurisdiction to hear the claims, because the exclusive forum for resolution of the dispute was governed by a collective agreement (Beaulieu v. Governors of the University of Alberta, et al.)
