  • Recently, the U.S. Department of Labor (the "DOL") issued a final regulation (29 C.F.R. ยง 2520.101-4) implementing a new annual funding notice requirement for multiemployer defined benefit pension plans (71 Fed. Reg. 1904). This final regulation, which is substantially similar to the initial proposal issued in 2005 (70 Fed. Reg. 6306), provides guidance to multiemployer plans in interpreting Section 101(f) of the Employee Retirement Income Security Act of 1974, as amended ("ERISA").
