• Labor Department Issues Fact Sheet on Mandatory Break Times for Nursing Mothers

  • A provision of the recently enacated health care reform legislation (PPACA) amended the Fair Labor Standards Act (“FLSA”) to require employers to provide “a reasonable break time for an employee to express breast milk for her nursing child for 1 year after the child’s birth each time such employee needs to express the milk.” Last week, the U.S. Department of Labor ("DOL") issued a fact sheet clarifying employers' obligations in this area.
