  • In 1997, the Supreme Court of Canada introduced the concept of "bad faith" in the assessment of wrongful dismissal damages. The Court in Wallace v. Grain Growers Ltd. ruled that employees subject to bad faith at the time of their dismissal could be entitled to additional notice (or pay in lieu of notice) than they would otherwise be entitled to.
