  • On November 13, 2008, the Environmental Appeals Board ("EAB") ruled that EPA did not adequately justify its failure to impose CO2 emissions limits in a Prevention of Significant Deterioration ("PSD") permit for a proposed coal-fired power plant in Utah, and remanded the permit to EPA for further consideration.
