Companies that manufacture or import polymers under the amended Toxic Substances Control Act (TSCA) polymer exemption rule (40 C.F.R. § 723.250) should keep in mind that the deadline for the one-time report required for polymers first manufactured or imported under the exemption in a calendar year is January 31 of the following year.
Paragraph (f) of the polymer exemption requires companies to notify the U.S. Environmental Protection Agency (EPA) of the number of polymers first manufactured or imported by the company under the exemption in the preceding calendar year. Certain administrative information must also be provided. Reports for polymers first manufactured or imported under the exemption in any one year must be postmarked by January 31 of the following year. If a company did not manufacture or import any polymers for the first time under the exemption in a given year, it is not required to (and, indeed, may not) report the following January.
