  • A pollution exclusion in a Directors and Officers liability policy will not be read to distinguish between traditional, outdoor environmental pollution and indoor air pollution for purposes of its application to a claim arising from a criminal action against the insured, says a Michigan federal district court. (Arch Ins. Co. v. Commercial Steel Treating Corp., 2013 WL 4536163 (E.D. Mich. August 27, 2013).)
