• California Court of Appeal Upholds Proposed Sacramento Kings Stadium Over CEQA Challenge

  • On February 18, 2015, California’s Third District Court of Appeal in Saltonstall et al. v. City of Sacramento upheld the City of Sacramento’s Environmental Impact Report (EIR) prepared for the proposed construction of the new Sacramento Kings’ basketball stadium in downtown Sacramento. In denying the Petitioners’ challenge under California Environmental Quality Act (CEQA), the Court held: 1) the city did not sufficiently commit to the arena project prior to completing its EIR; 2) the city's EIR analysis of traffic congestion was not deficient; and 3) CEQA did not require the city to study remodeling of the Kings’ existing arena as project alternative nor does it require the city to consider potential impacts to crowd safety.
