  • On May 18, 2016, the United States Environmental Protection Agency (USEPA) published a number of proposed amendments to the National Pollutant Discharge Elimination System (NPDES) regulations it believes will address the NPDES application, permitting, monitoring, and reporting requirements that have become obsolete or outdated over the past 35 years. The EPA believes these rule changes will make the NPDES regulations more consistent with both the Clean Water Act (CWA) and recent judicial decisions, clarify applicable compliance requirements, allow permit writers to use more consistent data for permitting decisions, and modernize opportunities for public notice and participation in NPDES permitting actions.
