  • In the past few months, both the New York State Department of Environmental Conservation ("NYSDEC") and the New York State Department of Health ("NYSDOH") have issued draft policy documents for investigating the potential impact for contaminants in soil or groundwater to impact indoor air quality ("vapor intrusion"). These policies could have sweeping impacts on sites within the State superfund program, brownfields sites, and sites within the voluntary cleanup program. Even previously remediated closed ("legacy") sites can be reopened under these new programs.
