• Colorado Coal Bed Methane Water Wells Subject to State Regulation

  • In Vance v. Wolfe, the Colorado Supreme Court held that water extraction that is a necessary result of coal bed methane (CBM) production is subject to the permitting requirements of state agencies. Ranchers brought the case claiming that the water extracted during CBM production was illegally depleting their groundwater rights. Conservationists were pleased with the decision as well because of the potential detrimental consequences of disposing of CBM groundwater into surface waters.
