  • Thirty-six years ago, in 1968, the country was in turmoil, struggling with the Vietnam War. Roe v. Wade would not be decided for six more years. The Women¿s Liberation Movement was not in full swing. Divorce was not the overwhelming phenomenon it would become by the early ¿70¿s. In most states, including New York, there was no equitable distribution of property, title controlled in divorce, marital misconduct (fault) barred the wife/mother from being awarded alimony (the statute was not gender-neutral), and the tender years presumption and mother-custody were not only the norm, but also, what most families of divorce opted for.
