  • 1. Distinction Between Divorce Under 23 Pa. C.S.A. ยง3301(c) and 3301(d). A. Both a 3301(c) and 3301(d) divorce are based upon the no-fault statute of the Divorce Code. In a 3301(c) divorce, both parties consent to the entry of the divorce decree, and moving forward with the divorce action. If the parties have been unable to settle equitable distribution between themselves, 90 days after a Complaint in Divorce has been filed and service accepted by the Defendant, both parties can sign their Affidavits of Consent and move forward with the process, which will include filing Inventories, scheduling a judicial conciliation, participating in discovery, if applicable, and eventually having a hearing on equitable distribution before a Special Master.
