  • In the well publicized divorce of hedge-funder Sage Kelly and his wife Christina, allegations of drug-use and partner-swapping, normally subject to a degree of confidentiality under Domestic Relations Law §235, became tabloid fodder when Mrs. Kelly brought a separate civil suit in a non-matrimonial court asserting her husband’s interference with her parental rights. In doing so, she not only set forth the purported elements of her cause of action, but also chose to attach the divorce complaint and an affidavit from the divorce action which further elaborated on her assertions in all their lurid details. As a result, these documents became open to the public (via the press) for all to see.
