  • The John Warner National Defense Authorization Act for FY 2007 (Public Law No. 109-364) made modest changes to the Berry Amendment. The Berry Amendment, 10 USC 2533a and 2533b, a domestic sourcing requirement for specialty metals, textiles, food stuffs and other specified items, applies only to Department of Defense (DOD) contracts. Unlike the Buy American Act and the Trade Agreements Act, the Berry Amendment flows down the supplier chain in a manner that is much more burdensome than the other laws.
