  • Many companies are under the misimpression that when the government obtains only limited rights in a company's technical data that the product or item described in the technical are similarly protected from disclosure to third parties. This alert highlights a recent case, rightly decided but for the wrong reasons, where a contractor's prototype was provided to a competitor and "reversed engineered."
